Statement on the judges’ decision to recuse themselves from considering Alaa's appeal

The Court of Cassation shocked us yesterday with the judges’ decision to recuse themselves from considering Alaa's appeal hearing regarding the Shoura Council case. Instead his case has been referred to another judicial circuit, scheduled for November 8th. We were given two unrelated, though equally baffling, explanations: one was that the judges had “cause for unease” (استشعر الحرج) with regard to the case. The other was that the court’s schedule was overcrowded. The hearing date for Alaa's appeal has been set for months.

There are two critical dates coming up that will determine whether Alaa is going to spend more years in prison or if there could be hope for his release.

  • 30th of September: The defendants in the case known as ‘Insulting the Judiciary’ will be sentenced. If found guilty the sentence can be anything between a fine and four years in a maximum security prison.

With deep pain the family announces the passing of Ahmad Seif al Islam Hamad, at 4.30 in the afternoon of Wednesday, 27 August.

Burial ganaza prayers will be held tomorrow, Thursday, after the 'Asr prayers in Salah el Din mosque in Manial.

The family will announce the place and time of the condolence aza soon.

After One Month

Alaa Abd El Fattah and Ahmad Abdelrahman have been in jail for a month. Their case was referred to the Criminal Court 20 days ago, but till now lawyers have not gained access to the case file, nor have we been able to find out which district court will try them, or when.

It took the Prosecutor's Office 2 weeks to investigate the case and refer it, but it's taken them 3 weeks to send the case file from the Prosecutor's office to the Court - and we don't yet know whether the file is complete and correct.

Complaints to the Public Prosecutor
